This Website Legal Notice, Terms of Use & Privacy Policy (collectively, the “Legal Terms”) governs your access to and use of www.dosomethingdocumentary.com, including its pages, forms, media, services, and related online features (collectively, the “Site”).
The Site is operated by The Do Something Tour and/or Do Something Documentary (“Do Something,” “we,” “us,” or “our”), with a mailing address at P.O. Box 293, Johnson, VT. 05656.
 
By accessing or using the Site, you acknowledge that you have read and agree to these Legal Terms. If you do not agree, do not use the Site. If you submit an interview request, story, photograph, video, recording, creative material, application, volunteer form, sponsorship inquiry, or other content, additional written terms or releases may apply.
 
1. Purpose of the Site
The Site provides information about the Do Something Tour, the Do Something Documentary, Facts Still Matter, associated productions, public-interest storytelling, interviews, events, fundraising, sponsorships, volunteer opportunities, and related educational or civic-engagement activities.
 
The Site and documentary may address political, governmental, social, cultural, legal, and other matters of public concern. Unless expressly stated otherwise, the project is independently produced and is not sponsored, endorsed, approved, or operated by any government agency, political party, candidate, platform, broadcaster, distributor, company, or person mentioned or depicted.
 
2. Informational and Editorial Disclaimer
Site content is provided for general informational, journalistic, documentary, educational, and commentary purposes. It is not legal, medical, financial, tax, investment, mental-health, or other professional advice. You should consult an appropriately licensed professional about your circumstances.
 
Documentary and editorial content may include opinions, allegations, historical material, interviews, satire, criticism, fair comment, or information supplied by third parties. Views expressed by guests, interview subjects, contributors, sponsors, or linked sources are their own and do not necessarily reflect our views. The inclusion of a person, organization, product, link, or viewpoint does not constitute endorsement.
 
We strive for accuracy but do not guarantee that every item is complete, current, error-free, or suitable for any particular purpose. Developing events may change previously published information. We may correct, clarify, update, remove, or decline to publish content in our editorial discretion.
 
To request a factual correction, email info@dosomethingtour.com with the page or content at issue, the specific statement you believe is inaccurate, your proposed correction, and supporting reliable sources. A request does not guarantee a correction, removal, response, or editorial outcome.
 
3. Eligibility and Children
The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you are under 13, do not submit information through the Site. If we learn that we collected personal information from a child under 13 without legally sufficient authorization, we will take reasonable steps to delete it.
 
If you believe a child has submitted personal information, contact info@dosomethingtour.com. Interviews, filming, submissions, or appearances involving minors require advance written permission from a parent or legal guardian and may require a separate minor appearance release. A minor’s use of the Site does not itself authorize filming or publication.
 
4. Acceptable Use
You may use the Site only for lawful, personal, and noncommercial purposes unless we give prior written permission. You may not:

• violate any applicable law or another person’s rights;

• impersonate another person or misrepresent your identity, affiliation, authority, or age;

• submit material that is unlawful, threatening, harassing, defamatory, fraudulent, obscene, invasive of privacy, exploitative, discriminatory, or intentionally false;

• submit confidential, classified, privileged, illegally obtained, or personally identifying information that you are not authorized to disclose;

• upload malware, malicious code, or content designed to disrupt, damage, monitor, or gain unauthorized access to systems or data;

• scrape, harvest, crawl, index, copy, frame, mirror, or use automated means to access the Site except as permitted by law or by our written consent;

• interfere with Site security, probe vulnerabilities, bypass access controls, or impose an unreasonable load on the Site;

• use Site content to train, develop, test, or improve an artificial-intelligence or machine-learning system without our prior written permission, except where such restriction is prohibited by law; or

• use our names, logos, content, or goodwill to imply sponsorship, endorsement, partnership, or affiliation without written authorization.
   

We may restrict or terminate access, preserve evidence, and report suspected illegal conduct when reasonably appropriate.
 
5. Intellectual Property
Unless otherwise stated, the Site and its original text, graphics, logos, photographs, video, audio, designs, compilations, software, and other content are owned by or licensed to The Do Something Tour and are protected by copyright, trademark, and other laws. Do Something Tour, Do Something Documentary, Facts Still Matter, associated logos, titles, slogans, and trade dress are trademarks or service marks of their respective owners.
 
You may view and share links to publicly available pages for lawful, noncommercial purposes. You may not reproduce, republish, distribute, publicly display, publicly perform, modify, sell, license, create derivative works from, remove attribution or rights notices from, or commercially exploit Site content without the owner’s prior written permission, except as allowed by law.
 
Nothing in these Legal Terms limits rights that cannot lawfully be waived, including applicable rights of fair use, criticism, commentary, news reporting, teaching, scholarship, or research.
 
6. User Communications and Submissions
The Site may allow you to submit messages, story ideas, documents, photographs, recordings, comments, interview requests, applications, or other material (“Submissions”). Do not send original or irreplaceable material. Do not submit sensitive personal information unless specifically requested and necessary.
 
You retain any ownership rights you have in a Submission. By voluntarily submitting material through the Site, you grant us a nonexclusive, worldwide, royalty-free license to receive, store, copy, and review it for the purpose for which it was submitted, to communicate with you about it, to evaluate it for possible editorial or production use, and to maintain reasonable archival and legal records.
 
A general Site Submission does not, by itself, grant us the right to include your name, likeness, interview, performance, private materials, or copyrighted work in the documentary or advertising. If we want broader production or promotional rights, we may ask you to sign a separate appearance release, material release, location release, license, assignment, or other agreement. That separate agreement will control if it conflicts with this section.
 
You represent that:

• you are authorized to make the Submission and provide the limited license above;

• the Submission and our permitted handling of it do not violate another person’s copyright, privacy, publicity, contract, confidentiality, or other rights;

• information you provide is truthful to the best of your knowledge; and

• you will identify material limitations, disputed facts, confidentiality concerns, safety risks, or third-party ownership claims known to you.
   

Submitting a story, pitch, proposal, idea, or creative concept does not create a confidential, fiduciary, employment, agency, partnership, or compensation relationship. We may already be developing or may later develop material similar to a Submission. Unless we separately agree in writing, we are not obligated to use, return, preserve, pay for, or respond to a Submission.
 
7. Interviews, Filming, Events, and Public Spaces
Contacting us or completing a Site form does not guarantee an interview, appearance, event placement, volunteer role, credit, compensation, publication, or inclusion in the completed documentary.
 
Interviews, private-location filming, performances, and certain submitted materials may require separately signed releases. Event notices may also state that photography, audio recording, or filming will occur. Where legally required or reasonably appropriate, additional notice and consent procedures will be used. Individuals who do not wish to be recorded should avoid designated filming areas or promptly speak with production staff; however, this statement does not waive any rights provided by applicable law.
 
We retain editorial control over selection, editing, sequencing, context, title, distribution, promotion, correction, and removal of content, subject to applicable law and any separate written agreement.
 
8. Donations, Contributions, Sponsorships, and Purchases
The Site may provide links or tools for donations, contributions, sponsorships, merchandise, tickets, or other payments. Payments may be processed by independent third-party providers under their own terms and privacy policies. We may receive transaction details but generally do not receive complete payment-card information when a third-party processor handles the transaction.
 
Do not represent any payment as tax-deductible unless the payment page or receipt expressly states that it is tax-deductible and identifies the qualified recipient. The Do Something Documentary, the Do Something Tour, and Facts Still Matter are not necessarily tax-exempt merely because a project has a public-interest purpose. If donations are accepted through a fiscal sponsor or qualified tax-exempt organization, that organization’s terms, restrictions, acknowledgment, and refund policies apply.
 
Unless a separate written agreement states otherwise:

• payments are voluntary and do not purchase editorial influence, favorable coverage, an interview, distribution, credit, or ownership in the production;

• restricted gifts will be accepted only if we expressly agree to the restriction in writing;

• sponsorship benefits are limited to those stated in a signed sponsorship agreement;

• contributions may be used for production, travel, insurance, editing, outreach, distribution, administration, fundraising, or other project-related expenses;

• donations are generally nonrefundable except where required by law or when we determine that a refund is appropriate; and

• merchandise, ticket, shipping, cancellation, and return terms shown at checkout are incorporated into these Legal Terms.
   

Sponsors and donors do not control documentary findings, interview questions, editing, or conclusions unless a clear sponsored-content disclosure states otherwise.
 
9. No Political-Contribution Solicitation
Unless a page expressly states otherwise and provides legally required disclosures, the Site does not solicit contributions for a candidate, political party, political action committee, ballot-measure committee, or other regulated political committee. A contribution to the documentary or tour is not a campaign contribution and does not entitle the contributor to political influence, a tax deduction, or a financial return.
 
10. Privacy Policy
10.1 Information We May Collect
Depending on the features you use, we may collect:

• Contact and identity information, such as name, email address, telephone number, city, state, organization, title, and social-media handle;

• Communications and submission information, such as messages, interview requests, story details, applications, attachments, photographs, audio, video, documents, survey responses, and correspondence;

• Transaction information, such as donation or purchase amount, date, billing contact information, transaction identifier, fulfillment details, and limited payment status information;

• Event and participation information, such as registration, attendance, accessibility requests, volunteer interests, availability, and signed release status;

• Device and usage information, such as IP address, browser type, device type, operating system, referring page, pages viewed, links clicked, approximate location derived from IP address, and date/time information;

• Cookie and similar-technology information, including identifiers used for essential Site operation, preferences, analytics, embedded media, fraud prevention, and—only if used and legally permitted—advertising; and

• Information from third parties, such as payment processors, email and form providers, analytics services, social networks, event platforms, fiscal sponsors, production partners, public sources, or people who refer you to us.
   

10.2 How We Use Information
We may use information to:

• operate, secure, troubleshoot, and improve the Site;

• respond to inquiries and communicate about interviews, events, volunteering, sponsorships, donations, purchases, and project updates;

• evaluate stories, sources, submissions, and production opportunities;

• process transactions and provide receipts, fulfillment, or customer support;

• send newsletters or promotional messages when permitted, with an unsubscribe method;

• produce, administer, document, promote, distribute, and archive project activities where separately authorized;

• measure audience engagement and Site performance;

• prevent fraud, abuse, security incidents, and violations of these Legal Terms;

• comply with legal obligations, enforce agreements, protect rights and safety, and resolve disputes; and

• carry out another purpose disclosed when information is collected or with your consent.
   

10.3 Cookies, Analytics, and Embedded Content
We and our service providers may use cookies, pixels, local storage, server logs, and similar technologies. The Site may also embed content from services such as YouTube, Vimeo, TikTok, Instagram, Facebook, X, fundraising platforms, maps, or podcast players. Those providers may collect information when you load or interact with embedded content, including when you have an account with them.
 
You can use browser settings to block or delete cookies, but some Site functions may not work correctly. Where required, we will request consent before using nonessential cookies. 
 
Our response to browser “Do Not Track” signals may vary because there is no universally accepted standard. Where applicable law requires recognition of a legally valid opt-out preference signal, we will process it as required.
 
10.4 How We Disclose Information
We may disclose information:

• to vendors and service providers that support hosting, security, analytics, forms, email, payments, fundraising, event administration, storage, production, distribution, and professional advice;

• to production partners, crew, fiscal sponsors, insurers, distributors, broadcasters, platforms, or event partners when reasonably necessary and legally authorized;

• when you direct us to disclose it or consent to the disclosure;

• to comply with law, subpoenas, court orders, or lawful government requests;

• when reasonably necessary to investigate fraud, security threats, illegal conduct, or threats to rights or safety;

• in connection with a merger, financing, reorganization, sale, transfer, insolvency, or other change involving all or part of the project or its assets, subject to applicable law; or

• in aggregated or deidentified form that is not reasonably capable of being associated with you.
   

We do not sell personal information for money. We do not knowingly sell or share for cross-context behavioral advertising the personal information of anyone under 16.
 
10.5 Data Retention
We retain information only as reasonably necessary for the purposes described above, including production and editorial records, transaction and tax records, consent and release documentation, dispute resolution, security, legal compliance, and enforcement. Retention periods vary by the type and sensitivity of information, legal obligations, operational need, and whether information is part of a journalistic or documentary archive. We may retain deidentified information where permitted by law.
 
10.6 Data Security
We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information. No internet transmission or storage system is completely secure, and we cannot guarantee absolute security. Do not send highly sensitive information through ordinary email or general Site forms.
 
10.7 Your Choices and Privacy Rights
You may unsubscribe from marketing emails using the link in the message. You may also contact us to update your contact information or request that we stop certain communications.
 
Depending on where you live and whether the relevant privacy law applies to us, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information; to opt out of certain sales, sharing, targeted advertising, or profiling; to limit certain uses of sensitive personal information; to withdraw consent; or to appeal a privacy decision. Legal exceptions may apply, including protections for journalism, free expression, documentary archives, legal claims, security, and information we must retain.
 
To submit a privacy request, email info@dosomethingtour.com. State the right you wish to exercise and provide enough information for us to identify the relevant records. We may verify your identity and authority before acting. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification. We will not unlawfully discriminate against you for exercising an applicable privacy right.
 
If we deny a request and your jurisdiction provides an appeal right, reply to our decision with the subject line “Privacy Appeal.” You may also have the right to contact your state privacy regulator.
 
10.8 California Disclosures
California law may require certain website operators to disclose their privacy practices. The categories of personal information we may collect, the sources, purposes, disclosures, and retention practices are described above. The Do Something Tour is not currently a “business” subject to the California Consumer Privacy Act because it is organized as a nonprofit entity and does not meet the CCPA’s definition of a covered for-profit business. Nevertheless, we respect privacy requests and provide the disclosures and choices described in this Privacy Policy. If our legal status, operations, or obligations change, we will update this Policy accordingly.
 
California residents may also request information under California’s “Shine the Light” law regarding certain disclosures of personal information to third parties for their own direct-marketing purposes, if that law applies. Send such requests to info@dosomethingtour.com with “California Shine the Light Request” in the subject line.
 
10.9 International Visitors
The Site is operated from the United States. If you access it from another country, your information may be transferred to and processed in the United States and other countries where our providers operate. Those countries may have privacy laws different from the laws where you live.
 
10.10 Third-Party Privacy Practices
This Privacy Policy does not govern third-party websites, platforms, payment processors, social networks, embedded services, or applications. Review their policies before providing information. We are not responsible for their privacy, security, availability, or content.
 
11. Copyright Complaints
If you believe material on the Site infringes your copyright, send a written notice to: info@dosomethingtour.com.
 
Your notice should identify the copyrighted work, identify the allegedly infringing material and its location, provide your contact information, state your good-faith belief that the use is unauthorized, state under penalty of perjury that the notice is accurate and that you are authorized to act, and include your physical or electronic signature. Knowingly materially misrepresenting infringement may create liability.
 
If we host user-directed material and seek the protections of the Digital Millennium Copyright Act, we may remove or disable access to material upon a valid notice, notify the affected user where appropriate, accept legally sufficient counter-notices, and terminate repeat infringers in appropriate circumstances. Posting an agent here does not replace registering and maintaining the agent with the U.S. Copyright Office when registration is required for safe-harbor eligibility.

Links to third-party websites and services are provided for convenience or reference. We do not control and are not responsible for their content, accuracy, security, accessibility, availability, products, practices, or policies. Your use of a third-party service is governed by its own terms. A link does not imply endorsement.

We aim to make the Site reasonably accessible to people with disabilities. If you encounter an accessibility barrier, contact us at info@dosomethingtour.com and identify the page, the problem, the assistive technology or browser used if relevant, and the best way to reach you. We will make reasonable efforts to provide access or an alternative format. This statement is an expression of our goal and does not admit that any particular accessibility law applies.
 
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DO SOMETHING TOUR/DO SOMETHING DOCUMENTARY, ITS AFFILIATES, PRODUCTION PARTNERS, FISCAL SPONSORS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, THIRD-PARTY SERVICES, OR RELIANCE ON SITE CONTENT.
 
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE LEGAL TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US THROUGH THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
 
These limitations do not apply to liability that cannot legally be excluded or limited, and they do not alter rights under a separately signed agreement.
 
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless THE DO SOMETHING TOUR/DO SOMETHING DOCUMENTARY and its affiliates, officers, directors, employees, contractors, volunteers, agents, production partners, and licensors from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your material breach of these Legal Terms, your Submission, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from the indemnified party’s own unlawful conduct. 
 
17. Governing Law and Disputes
These Legal Terms are governed by the laws of the State of Vermont, without regard to conflict-of-law principles, except to the extent federal law or another jurisdiction’s nonwaivable law applies. Any court proceeding arising from these Legal Terms or the Site must be brought in the state or federal courts, and each party consents to their personal jurisdiction and venue, unless applicable law provides otherwise.
 
Before filing a claim, you and we agree to make a good-faith effort to resolve it informally. Send written notice describing the dispute and requested resolution to info@dosomethingtour.com. This informal-process language does not shorten any limitations period or prevent either party from seeking urgent injunctive relief.
 
No mandatory arbitration or class-action waiver is included in this draft. Add either only after advice from counsel and a deliberate business decision.
 
18. Changes to the Site or Legal Terms
We may modify the Site and these Legal Terms. The “Last updated” date will identify the latest version. If changes are material, we may provide additional notice where required. Changes apply prospectively when posted or on the later date stated in the notice. Your continued use after the effective date constitutes acceptance to the extent permitted by law.
 
19. Suspension and Termination
We may suspend or terminate Site access when we reasonably believe a user has violated these Legal Terms, created legal or security risk, or interfered with the Site or another person. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, liability, indemnity, dispute, and records provisions—will survive.
 
20. General Terms
These Legal Terms, together with any additional terms expressly incorporated by reference, form the agreement governing the Site. A separately signed agreement controls over these Legal Terms for its specific subject matter. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Legal Terms without our written consent; we may assign them in connection with a lawful organizational change, production transfer, financing, or sale. Headings are for convenience only.
